Sexual assault by a person who is known to you, including sexual assault by your spouse, is a crime. If you are sexually assaulted, call 9-1-1 immediately or go to the nearest hospital and request a Sexual Assault Response Team (SART) exam. Please DO NOT wash, shower, douche, change clothes or brush your teeth. A forensic nurse examiner specially trained to provide an evidentiary exam, a law enforcement officer to conduct an investigation, and a victim advocate for emotional support will be available to you.

When you call the number or send an e-mail, please be prepared to provide the following information:

  • Your name at the time of the assault
  • Your contact information (phone number or e-mail address)
  • Jurisdiction (city) where the crime took place
  • The date or approximate date of the incident
  • A case number (if you know it, or other case identifiers)

All information provided to the Sheriff’s Department is confidential and will only be used to locate your case and continue any follow up related to that case.

 


Your Rights

  • You have the right to have a victim advocate and a support person of any gender present at any interview by law enforcement, district attorney or defense attorney; and to have them present during any medical evidentiary or physical examination. A Sexual Assault Counselor can be contacted 24 hours a day. However, the support person may be excluded from an interview by law enforcement or the district attorney if they determine that the presence of that individual would be detrimental to the purpose of the interview.

  • You have a right to request the results of the analysis of any sexual assault forensic evidence that is collected. Contact your local Sheriff’s Station handling your case or the California Attorney General’s Victims’ Services Unit 1-877-433-9069 www.oag.ca.gov/sexual-violence for the status of your rape kit in the SAFE-T database.

  • You are not required to participate in the criminal justice system or to receive a medical evidentiary or physical examination in order to retain your rights under law. Should you choose to undergo a medical or physical examination, it is important to undergo the examination within 72 hours of the incident, because DNA evidence starts to degrade. If sexual assault forensic evidence will be tested, it should be transported to the Crime Laboratory and analyzed within two years from the date of the offense. The Sheriff's Department or crime laboratory will retain the sexual assault forensic evidence for at least 20 years, or if the victim was under 18 years of age at the time of the alleged offense, at least until the victim’s 40th birthday.

  • You have the right to request that your name be kept from public record in any law enforcement report where you were listed as the victim of a sex crime. You can receive a free copy of your report upon request. Please contact the detectives at your local Sheriff’s Station.

  • You have the right to receive an Emergency Protective Order or to go to the Superior Court and file a petition requesting a court order for protection. For more information please contact:

  • You have the right to file a civil suit for losses suffered as a result of the abuse, including medical expenses, loss of earnings, and other expenses for injuries sustained and damage to property, and any other related expenses incurred by you or any agency that shelters you.
